These terms govern your use of temesconsulting.com and, where noted, the services we provide to dealerships. Questions: [email protected] or (908) 216-0975.

A signed event agreement controls. When you engage us for a sales event or marketing program, you sign a separate written agreement. If anything in that signed agreement conflicts with the terms on this page, the signed agreement governs. This page describes our general terms and the terms for using this website.

1. Who we are

Temes Consulting Inc. provides consulting, marketing, and technology services to automobile dealerships — including staffed sales events, invitation campaigns, service marketing, lead generation, and done-for-you social media. We market business-to-business only.

3. Contact form and outreach

Submitting our contact form asks us to get in touch about the products or services you selected. It does not create a contract or reserve event dates. How we handle the information you send is covered in our Privacy Policy. You can opt out of our email at any time using the unsubscribe link in any message.

4. Engaging us for an event

Event work is booked by written agreement that specifies your dealership, event dates and times, event type, invitation quantity, program add-ons, staffing, and total price. Nothing is reserved until that agreement is signed.

5. Cancellation and refunds

Unless your signed agreement says otherwise, the following applies to booked events:

Temes Consulting may cancel an event at any time by refunding your money in full.

6. Responsibilities during an event

The dealership agrees to cooperate with us before, during, and after the event; provide a complete sold report for all vehicles sold up to 7 days before and 5 days after; make a meeting room available 60 minutes before the event for staff review; maintain adequate inventory quantity and quality; and allow Temes Consulting the final turn with every client.

Temes Consulting agrees to conduct a staff meeting 30–60 minutes before the event starts; greet every client and guide them through registration; personalize and print event invitations after dealer sign-off; pay all postage and provide postal receipts on request; select the mailing list (zip codes, conquest, and/or dealership database); and submit pre-approvals for co-op or PAP.

7. Invitations, advertising, and legal review

We will revise event invitations to meet co-op approval requirements and will provide your legal counsel a copy before the printing date. Your legal counsel reviews, edits, and signs off on the invitation before it prints. Temes Consulting has no legal obligation with respect to an invitation approved by your legal counsel.

We comply with applicable state laws and regulations, including advertising and contest-of-chance rules, and will not engage in any illegal activity.

8. Use of mailing lists

Any list of names supplied for an event promotion is strictly for use in connection with that sales event. It may not be used for any other purpose, and it may not be sold or transferred to any company or individual for any purpose, including marketing to anyone on that database.

9. Results

Any figures we publish describing typical event performance are illustrations based on past engagements. They are not a guarantee. Actual results depend on your inventory, staffing, market, pricing, and execution.

10. Payment

Event pricing, deposits, and payment timing are set in your signed agreement. Amounts are due as stated there. Fees are exclusive of any applicable taxes.

11. Intellectual property

Our invitation designs, campaign materials, process documentation, software, and site content remain our property. Work we produce for your event may be used by your dealership for that event. We retain the right to describe the work generally in our own marketing, without publishing your dealership's name unless you agree.

12. Limitation of liability

To the fullest extent permitted by law, Temes Consulting is not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising out of these terms or our services. Our total liability for any claim will not exceed the amount you paid us for the engagement giving rise to the claim. Nothing here limits liability that cannot be limited under applicable law.

13. Governing law and disputes

These terms and any engagement are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any legal action will be filed in the state or federal courts located in Palm Beach County, Florida, and both parties consent to that jurisdiction. The prevailing party in any legal proceeding will recover its attorney fees and costs.

14. Changes to these terms

We may update this page. The "last updated" date above reflects the current version. Changes apply going forward and do not alter a signed agreement already in effect.
